The Committee on the Colorado Rules of Professional Conduct is a Standing Committee established by the Colorado Supreme Court in 2003. The Committee is charged with periodically reviewing, correcting, updating, and improving the Colorado Rules of Professional Conduct.
Before the Committee was formed, a number of different Court-appointed and bar association committees and task forces, as well as other groups and individuals, made requests and recommendations directly to the Court concerning possible rule changes. The Court continues to welcome suggested changes to the Rules of Professional Conduct by any entity or person; however, the Court expects the Standing Committee to consider those recommendations in the first instance.
The Supreme Court Liaisons to the Committee are Justice William W. Hood, III and Justice Maria E. Berkenkotter. The Committee Chair is Judge Lino S. Lipinsky de Orlov of the Colorado Court of Appeals. The Committee is comprised of members of varying backgrounds, including trial-level judges, appellate judges, law school professors, disciplinary prosecutors, and attorneys in private practice in a broad range of practice areas.
The Committee as a whole will meet approximately four times per year . A variety of subcommittees will meet at other times to discuss changes to particular rules or to deliberate on specific topics.
The Supreme Court has repealed and reenacted the Colorado Rules of Professional Conduct, effective January 1, 2008. The reenacted rules differ in many respects from the previous rules, and also differ in some respects from the proposal made by the Standing Committee on December 27, 2005, which is available among the links below. The current Colorado Rules of Professional Conduct are available from LexisNexis. Click the plus sign before “Colorado Rules of Civil Procedure” and then the plus sign before “Appendix to Chapters 18 to 20” to access them. Additional proposed and adopted changes to the Colorado Rules of Professional Conduct are available on the Supreme Court's website.
